i think Josh will just win just based on the odds, combined with the "lolcow modifier" like everyone here assumes he'll lose, so therefore he has to win.

i'm sure Josh has enough experience now that him and his lawyer judge shopped like motherfuckers. they probably filed a lawsuit in a place where every judge has experience being attacked by trannies or something insane like that.

The problem is that even if he wins this case, there's going to be another and another and another until the troons get what they want. There's blood in the water thanks to the fecklessness of Trump's presidency, that's why Jones feels confident enough to return and try another attempt at taking out Kiwi Farms. Keep in mind that Null's donations, as big as they are now, only got to that point due to a mixture of Jones doing his lawsuit, making people realize that they'll be next when Null falls and Null telling his users they needed to donate now or he was shutting KF down. Notice that none of his mods are publicly backing him up on this.

That's one thing I funny here. Hardin/Josh is telling the judge that LFJ is operating on bad-faith and is only using copyright law to try to attack KF, which is true; that LF doesn't actually care about his copyright images being violated. But Hardin/Josh are acting like they are good boys who dindu nuffin. Their bad-faith dichotomy is pretty apparent if you step away from the strict legal documents they hand to the judge. Act prim, proper, and professional for the judge. And then on your own website and podcast, which are visible to all, you put up banners depicting LFJ as a demonic, undead, gray-skinned zombie with glowing red eyes and sharp teeth, with hands outstretched to seize and destroy the Kiwi bird avatar logo of the site. And I'm sure Josh's trashing LFJ on his podcast (I haven't watched the latest one yet) and in text on the site. LFJ was apparently using programs to transcribe all of Josh's podcasts into text form in the past, so he clearly listens to everything Josh says about him and monitors his every move. So Hardin/Josh act one way for the court and act completely different on the site. Something like this could cause the judge to rule against them, even though the dispute is supposed to be purely about copyright law. You never know. Judges can do whatever they want basically and then just provide some crap arguments justifying it, after the fact. And cite a case law here and there to make it look legit. And it's done.

I assume that if this singular judge is overseeing an entire district this means that any case that hurls its way into said district indeed is handled by her. All of this to say that for certain this kaween is the one who is going to rule in the upcoming Lolcow LLC v. Fong-Jones case. Like it is boringly definitively over now. If calling him a rapist was so inherently defamatory, why did he have to sue someone tangentially linked to Josh in Australia, a jurisdiction where it is very easy to win a defamation suit. LFJ is very litigious, and if he believed he could win a defamation suit in the US, he would have tried a long time ago. LFJ is not shy to that either, since he legally compelled Kiwi Farms user Kevin Crawley to write a KF post admitting he lied about working alongside LFJ (lest Kevin get sued for defamation, since his allegations were a lot less legally defensible than the consent accident rape meme). This is why LFJ is trying to use the DMCA against Kiwi Farms, because I guarantee his lawyers explained to him that it is by far his best option compared to a very risky defamation suit. None of that is relevant in this case. Even Greer's successful case against Josh does not rely on the thread being deemed harassment, it is because Josh was a retard and ignored what was at best a fair use edge case and he got put in front of unsympathetic courts. He is likely to find the same here, but neither LFJ's lawyers nor Hardin are bringing up the content.

LFJ getting everyone's IPs and emails is never going to happen. His lawyers explained the law which says LFJ gets 150K for every picture deemed willfully infringing, which is 3, so he wins 450K from Josh. At no point does the userbase or how many people posted in the thread come into it, except maybe the 3 posters who posted those pictures.

That point does makes me wonder if Josh would throw those users under the bus like he has with other court cases. Personally I do not think LFJ would let him since he hates Josh more than any individual Kiwi.
 
I see two possible routes in the case Null does not get a sympathetic ruling. He’s either going to shut down the website to prevent an influx of DMCAs from other vexatious litigants who will see this as a prime opportunity to get their material taken down, or he will rat out whoever he thinks he needs to rat out in order to get the court off his back, which will scare off people from joining even more and scare off older users from remaining active on the website out of fear that their anonymity can be that easily revoked.

Don’t get me wrong, I hate both sides. But I hate Josh more and I think getting ass-raped in court is a fitting ending for him.
