That's one thing I funny here. Hardin/Josh is telling the judge that LFJ is operating on bad-faith and is only using copyright law to try to attack KF, which is true; that LF doesn't actually care about his copyright images being violated. But Hardin/Josh are acting like they are good boys who dindu nuffin. Their bad-faith dichotomy is pretty apparent if you step away from the strict legal documents they hand to the judge. Act prim, proper, and professional for the judge. And then on your own website and podcast, which are visible to all, you put up banners depicting LFJ as a demonic, undead, gray-skinned zombie with glowing red eyes and sharp teeth, with hands outstretched to seize and destroy the Kiwi bird avatar logo of the site. And I'm sure Josh's trashing LFJ on his podcast (I haven't watched the latest one yet) and in text on the site. LFJ was apparently using programs to transcribe all of Josh's podcasts into text form in the past, so he clearly listens to everything Josh says about him and monitors his every move. So Hardin/Josh act one way for the court and act completely different on the site. Something like this could cause the judge to rule against them, even though the dispute is supposed to be purely about copyright law. You never know. Judges can do whatever they want basically and then just provide some crap arguments justifying it, after the fact. And cite a case law here and there to make it look legit. And it's done.
