Josh originally made a dedicated link to download this material, he also distributed it using MEGA before it was obviously nuked for being illegal. He was also fully aware that he could be “forced to delete this”



The Content Included

Some of the content is directly hosted on the site in the initial directory (not in ZIPs, etc) and the individual videos are downloadable directly from the Kiwi Farms directory.



And that is only one part of the directory. This archive has zips full of photographs, videos, and more just public and open for anyone to download.

Legality

On November 25, 2019, President Donald Trump signed the Preventing Animal Cruelty and Torture (PACT) Act into law.

Under the PACT Act, sharing “animal crush” content was made federally illegal in the United States.

It shall be unlawful for any person to knowingly sell, market, advertise, exchange, or distribute an animal crush video in, or using a means or facility of, interstate or foreign commerce.

Animal Crush is defined as:

any photograph, motion-picture film, video or digital recording, or electronic image that—
(A) depicts animal crushing; and
(B) is obscene

The term “animal crushing” is

actual conduct in which one or more living non-human mammals, birds, reptiles, or amphibians is purposely crushed, burned, drowned, suffocated, impaled, or otherwise subjected to serious bodily injury

obscene material:

covers work that “depict or describe sexual conduct.” In deciding whether or not material is obscene, one must look at:
(1) whether “the average person, applying contemporary community standards” would find that work, taken as a whole, appeals to the prurient interest;
(2) whether the work depicts or describes, in a patently offensive way, sexual conduct specifically defined by the applicable state law; and
(3) whether the work, taken as a whole, lacks serious literary, artistic, political, or scientific value (Miller v. California). Obscene material does not receive First Amendment protection, but “sexual expression which is indecent but not obscene is protected by the First Amendment.” (Reno v. American Civil Liberties Union).

Josh believes that his hosting of the content falls under “Good Faith Distribution,” and is therefore legal.

(B) a third party for the sole purpose of analysis to determine if referral to a law enforcement agency is appropriate.

Josh claims on the very front warning page something very damning — something that completely invalidates his only possible claim to legality.

Now for the lesser known zoosadist porn jackpot that Josh really wanted to host so bad for some reason. The Animal Gore thread was created by Josh himself. It was a place for him to upload his links to animal gore material. The thread only garnered 30 replies before it was moved to spergatory.



Notice anything about that? The thread is in spergatory. Josh isn’t saving it or presenting it as evidence, he’s simply just hosting the content.

The page even has its own warning, citing that there was “no reason” to use it. Whats the purpose of hosting this content for “no reason” Josh?
