So looking more into the "subpoena" (and I put this in quotes because it's likely not going to go anywhere).
It seems Pxie's lawyers also subpoenaed Discord, Google, and Instagram to preserve said chats and to take down the revenge porn (this was earlier this month).
Although it may be pretty retarded on Pxie's part to subpoena an entire thread for several reasons. Much of the content that was posted there are mostly done by oldfags prior to the Keffals shitshow (a lot of those oldfag accounts haven't been logged in since 2020 to 2022 where Jersh had to lock down said accounts after a data breach), many of the active posters don't really seem to live in the states, and according to a now locked thread involving an unrelated FBI case from last year, Jersh acknowledges (if he's telling the truth) that due to Kiwi Farms' data retention policy (where he claims Kiwi Farms stores said private information for a short period of time) he was unable to provide the FBI the relevant IP addresses because Jersh retains that information for a short period of time so he couldn't give anything to the feds if he doesn't have it.
So if what Jersh is saying is true about how security practices are done on Kiwi Farms then the information that Pxie's lawyers are mostly going to receive are no IP addresses from really old (and now dead) Kiwi Farms accounts, throwaway emails that have no attachment to any real world identities (assuming most of the Kiwis are smart enough to do this), any IP addresses that are still logged are most likely from VPNs or Tor (should said active Kiwis practice good OPSEC), and probably log-in information. This is going to be mostly useless information to Pxie's lawyers (this is why I think Jersh called the subpoena being not clever). So out of the many hundreds of posters on that thread, I think only a very small handful of people from Kiwi Farms that are relevant to the lawsuit may be called to the stand should this lawsuit go further.
Honestly, I don't really see this case going further and it's most likely Destiny may come out of this unscathed much like DarksydePhil whenever DSP finds himself in a pickle. There's a very good chance this lawsuit may end up like the lawsuits done by Vic Mignogna and Karl Jobst when they tried it and their lawsuits got tossed out due to technicalities. I think this is what Destiny is depending on, that his lawyers find some technicalities that makes the court toss the lawsuit away.
Should the lawsuit go forward, there is also the high chance that Destiny may want to settle this out of court and give Pxie an undisclosed cash settlement and conditions that satisfies Pxie's legal team and the lawsuit ends just like that (which often happens with many civil cases).
If you ask me, Destiny will most likely come out of this unscathed, the lawsuit will either get tossed out over a technicality or settled out of court, and this will most likely be another case of nothing ever happens.
