Apparently he didn't properly serve Josh papers or something since there was no evidence he did. They toss out cases if you don't serve them the proper paperwork, whether there is anything to their claims or not iirc.
Reason: There are ways around people avoiding being served papers like Josh who hide where they live. But I don't think he was smart enough to figure out how.
