Don't get me wrong I don't want to talk to the guy, my sympathy for him doesn't extend far enough to suffer the presence of a zero-social-skills autist which he likely is, but "hate"? Who the fuck hates someone like that? It's like hating people with Down's syndrome.

Maybe, but what other choice does he have at this point? Keep in mind that he moved back to America because he thought Trump winning meant that he would be secured and people like Jones would be cast into the shadows, and now those same people, Jones included, feel confident enough in their future victories to restart #DropKiwiFarms. The walls are closing in for him and I think he's going to take any exit possible that he can afford.

So what do I see when Jersh is being once again financially irresponsible? He decides to sue a troon that hasn't been a threat to Internet free speech since the days of Keffals. Didn't Jersh just recently put it on record that if he finds himself in legal trouble again that may be the end of Kiwi Farms? So why is he suing a troon most people on the Internet have forgotten now and there is a high possibility that he may either lose in his lawsuit or his lawsuit gets diminished by a judge? That money that the Kiwis have donated to Jersh for this lolsuit may likely be in vain.

It is not as pointless or irresponsible as you are saying. Josh is suing LFJ so that a judge pre-emptively dismisses LFJ's copyright violation claim he has raised against him. The way the law is set up means Josh HAS to sue LFJ now, otherwise LFJ gets another piece of ammo against him to use in his own lawsuit against Kiwi Farms. And this is no empty threat from LFJ since he is using a loophole in copyright law to legally remove posts in his thread. The problem for LFJ is that Kiwi Farms has a good case for fair use therefore LFJ is committing DMCA abuse.

I think Josh started poorly in this lawsuit. He should have complied with the DMCA request, put up a passive aggressive message explaining why it was censored (like he does for all the revenge porn he has to remove), and fought the DMCA in court. Leaving it up has opened him to additional liability and potentially killed a very winnable case before it even began (remember the Greer case) or maybe even opened him to getting far more legal penalty (to the tune of 300,000 dollars).

Basically this was always going to be a lawsuit since the alternative is letting LFJ moderate his own thread and no doubt other threads using the DMCA, the only difference is who sued who first. I do not believe Josh will continue to sue LFJ if he wins, since Josh lacks any claim on him (beside getting the court to rule that LFJ's DMCA claims are bunk). Beside, why would Josh want to sue LFJ when he can take advantage of him as the scary litigious bogeyman about to snuff out free speech on the internet unless you donate to the "United States Internet Preservation Society." Actually winning a lawsuit against him (for what, I have no idea, hence why Josh would lose an actual lawsuit against LFJ) would mean less donations.

As for the mysterious jump in people writing Josh checks, I think it is obvious that a big financial donor (Gabe Hoffman maybe) just dropped Josh a few thousand bucks and Josh updated the stats to give the impression there are hundreds of new donors. Josh is absolutely going to milk the "free speech under attack" angle because like I said, this is a grifter vs grifter lawsuit.

So LFJ threatened to sue Null for copyright infringement, but Null claims that copyrighted materials were used in the context of protected Fair Use criticism, so that doesn't constitute a copyright violation.

If I understand this correctly, Null wants the NY court to affirm that KiwiFarms has a Fair Use right enable users to criticize public figures such as LFJ, including the use of copyrighted materials such as a Bsky post or a troon's glamour shot as part of that Fair Use criticism, and since such a judgement under USC 28 section 2201 has "the force and effect of final judgement", then LJF will not be able to file the copyright lolsuits he's been threatening to file against KF. So Null is using USC 28 to pre-empt LFJ carrying out his legal threats.

I have a question about this statement though, in paragraph 8 on page 3:

Check the lawsuit page on Kiwi Farms. Hardin asserts that one picture is fair use because it is necessary to illustrate the subject for the purpose of the commentary (which was ample and explicitly about the photograph), and the other was edited with text which also constitutes commentary as well as parody (as it uses the consent accident meme). It also appears that Hardin is arguing from copyright law while LFJ's lawyers believed Hardin was using BlueSky's own terms of use to assert fair use. So in that respect, Hardin is one step ahead.

Where I would not be so confident is the lack of proper response to the DMCA claims, as well as the first image. Wikipedia for instance does not use photographs it cannot assert proper copyright claim toward, sometimes even on famous people's articles. Kim Jong Un had some random guy's sketch of him for years because news media owned the copyrights to official North Korean pictures and for whatever reason North Korea's own copyright laws were respected, or something like that. To my knowledge, this situation might be different because the infringing post specifically provided commentary on LFJ's picture while a Wikipedia article on Kim Jong Un is about the subject as a whole.

In any case, I do not think this is an attack on free speech. LFJ is not making new laws or precedents, since DMCA trolls have been around since the DMCA itself. LFJ is using this to settle an old conflict that he himself started (Kiwi Farms ignored him until ~2021 when he started freaking over a 2 year old thread laughing at his 2019 DMCA request) and to put it on his resume for his reputation management company that he was the guy who took down the big bad Kiwi Farms. For people Null explicitly hates and targets, LFJ is among the least sympathetic because he basically started this entire thing himself.
