Whatever, insert any country where fucking really low age kids is legal and the concept of my argument still stands.The age of consent in Nigeria is 18 years old, but the law is inconsistently applied across the country. The discrepancy is largely due to the existence of different legal frameworks governing different regions.
Legal frameworks in Nigeria
Complicating factors
- Child Rights Act (CRA): This federal law, which has been adopted by many but not all Nigerian states, sets the age of consent at 18. Under the CRA, any sexual intercourse with a person under 18 is considered rape.
- Criminal Code Act: This law applies to the states in Southern Nigeria. It also stipulates the age of consent as 18.
- Penal Code Act: This law governs the Northern states and is influenced by Sharia law. Under the Penal Code, the age of consent for girls depends on their marital status, not their age. This means a girl who is married is considered to be of full age, regardless of her actual age.
- Adoption of the CRA: Not all states have fully adopted and domesticated the Child Rights Act. In some states, especially in the North, older interpretations of the law or local customs regarding child marriage may still be practiced.
- Child marriage: The practice of child marriage continues, particularly in Northern Nigeria. This is sometimes justified by the Penal Code and a controversial constitutional provision stating that "any woman who is married shall be deemed to be of full age".
- Efforts to raise the age: Organizations like the Malala Fund have run campaigns, such as the #raisetheage petition, to advocate for a single, consistent age of consent of 18 across Nigeria.
