In order for this to be malicious I would have to have forced Josh to infringe on the content and then forced him to reject the DMCA claims. I don't live in that retard's brain. You do. At best what you suggest would reduce my claim of willful infringement down to innocent infringement which is unlikely seeing as Jersh knew about the watermark removal, rejected the DMCA claim for it, and then posted the DMCA claim for said video. All of which are aspects of willful infringement by themselves.
